Fundamental Design Lab, Inc.  (“we,” “our,” or “us”) respects your privacy and is committed to protecting it through compliance with this Privacy Policy (“Policy”).  This Policy is pursuant to our Terms of Service, and in the event of any conflict or inconsistency, the Terms of Service shall take precedence.  This Policy describes how we may collect, use, share, and protect information when you access or use our websites, mobile applications, and other online products and services (collectively, the “Services”), as defined in our Terms of Service.  It applies to information collected online through our Services, including via email, text, or other electronic communications, and when you interact with our advertisements or applications on third-party platforms that link to this Policy.


This Policy does not apply to information collected offline, through other means, or by third parties (including our affiliates or subsidiaries) whose services or content may be linked to or accessible from our Services.  By using our Services, you consent to this Policy and our Terms of Service.  If you do not agree, please do not use our Services.


We may update this Policy at our sole discretion.  If we make material changes to how we treat our users' personal information, it is our policy to notify you via the Services. Changes are effective immediately upon posting with an updated Effective Date.  Your continued use of the Services after changes constitutes acceptance.  You are responsible for checking this Policy periodically for updates, per our Terms of Service.

Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Services. Our Services may include links to third-party sites, payment processors (e.g., Stripe, PayPal), or social media features.  These are governed by their own privacy policies, and we are not responsible for their practices or content, per our Terms of Service.  Review their terms before engaging.


Geographic Restrictions

Our Services are based in the United States and subject to U.S.  laws.  Non-residents must not use our Services for purposes unlawful under U.S.  federal or state law, per our Terms of Service.


Governing Law and Dispute Resolution

This Policy is governed by Delaware law, as stated in our Terms of Service.  Disputes must first be addressed informally by contacting info@fundamentaldesign.com, though we are not obligated to respond.  If unresolved, disputes may be subject to binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules, at our discretion, per our Terms of Service.
